1. Agreement to These Terms
These Terms and Conditions constitute a legally binding agreement between you and DR Crafted Creations LLC, doing business as The Keepsake Blossom & Co. (“The Keepsake Blossom & Co.,” “Company,” “we,” “us,” or “our”).

These Terms govern your access to and use of:

  • Our website;

  • Our Wix online store;

  • Floral preservation services;

  • Resin keepsakes;

  • Custom engravings;

  • Acrylic signs;

  • Personalized products;

  • Ready-to-ship products;

  • Custom-order forms;

  • Quotes, proposals, invoices, and payment links;

  • Customer accounts;

  • Local pickup or delivery services;

  • Social-media ordering and communications; and

  • Other products or services offered by The Keepsake Blossom & Co.

By visiting our website, creating an account, submitting an inquiry, booking a service, accepting a proposal, signing an agreement, paying an invoice or deposit, approving a proof, mailing flowers or other materials to us, or purchasing a product, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, do not use the website, place an order, submit materials, or purchase our products or services.

2. Business Information
This website and business are operated by:
Legal Entity: DR Crafted Creations LLC
Doing Business As: The Keepsake Blossom & Co.
Mailing Address:
1527 W. Craig Rd., STE 1B-500
North Las Vegas, NV 89032
Email: info@thekeepsakeblossom.com
Website: www.thekeepsakeblossom.com
Social Media: @thekeepsakeblossom

The listed address is a mailing and receiving location rather than a public retail storefront. Customers must not arrive for a consultation, delivery, or pickup without a confirmed appointment or pickup arrangement.

3. Eligibility
You must be at least 18 years old and legally capable of entering into a contract to place an order or book a service.

Nevada generally considers individuals who have reached 18 years of age and are not under a legal disability capable of entering contracts.
If you are under 18, a parent or legal guardian must submit and accept the order on your behalf.

By using the website or placing an order, you represent that:

  • You are at least 18 years old or are acting with the involvement of a parent or legal guardian;

  • You have the legal capacity to enter into this agreement;

  • The information you provide is accurate and complete; and

  • You are authorized to use the selected payment method.

We may refuse or cancel an order if we reasonably believe the person submitting it lacks legal authority or is using another person’s information or payment method without authorization.

4. Electronic Communications and Consent
You consent to conducting transactions electronically.

Electronic acceptance may include:

  • Selecting an agreement checkbox;

  • Submitting an online order;

  • Paying an invoice or deposit;

  • Applying an electronic signature;

  • Replying with written approval by email or message;

  • Approving a digital proof;

  • Clicking an acceptance button; or

  • Otherwise electronically communicating agreement.

You agree that electronic records, notices, order confirmations, proofs, invoices, policies, and signatures may satisfy requirements that information be provided in writing.

You are responsible for maintaining a current email address and telephone number and for reviewing communications relating to your order.

Nevada law generally recognizes electronic records, electronic signatures, and electronically formed contracts.

5. Additional Policies
The following policies are incorporated into these Terms by reference:

  • Privacy Policy;

  • Shipping Policy;

  • Returns, Refunds, Cancellations & Replacement Policy;

  • Accessibility Statement;

  • Floral Preservation Agreement, when applicable;

  • Product Care Instructions;

  • Product descriptions;

  • Written proposals and invoices; and

  • Any additional written terms accepted for a particular order.

These documents should be read together.

When a signed floral preservation agreement, custom-order contract, approved proposal, or invoice contains terms that differ from these general Terms, the more specific written agreement will control for that order to the extent of the conflict.

Nothing in these Terms eliminates a consumer right that cannot legally be waived.

6. Products and Services
The Keepsake Blossom & Co. may offer:

  • Floral preservation;

  • Wedding bouquet preservation;

  • Memorial and funeral flower preservation;

  • Resin floral keepsakes;

  • Standing hearts and other preservation shapes;

  • Custom engravings;

  • Acrylic signs;

  • Personalized gifts;

  • Ready-made preservation pieces;

  • Custom-designed products;

  • Related design services; and

  • Other products or services displayed on our website or offered in writing.

Products, services, designs, sizes, shapes, colors, materials, availability, production methods, and prices may change.

We may discontinue a product or service at any time. A discontinued product will not affect an already accepted order unless materials become unavailable or fulfillment becomes impracticable, in which case we will communicate with the customer regarding reasonable alternatives, cancellation, or any refund required by law.

7. Floral Preservation Services
Floral preservation is a custom artistic service involving natural, perishable, and often irreplaceable materials.
The customer acknowledges that:

  • Flowers begin changing naturally immediately after they are cut;

  • Flowers may arrive wilted, bruised, browned, broken, dehydrated, moldy, or otherwise deteriorated;

  • Some flowers may not be suitable for preservation;

  • The drying and preservation process may alter color, size, texture, shape, transparency, or appearance;

  • White flowers may become cream, ivory, translucent, yellowed, or browned;

  • Red, purple, pink, blue, and other flowers may darken, fade, or change tone;

  • Greenery may change color or texture;

  • Bruising and prior damage may become more visible during preservation;

  • Not every flower supplied can necessarily be included;

  • Resin and other preservation methods cannot permanently prevent all natural aging; and

  • The completed piece may continue to change over time.

No preservation method can guarantee that flowers will permanently retain their original fresh appearance.

Natural flower changes are not automatically defects or evidence of improper workmanship.

8. Condition of Customer-Supplied Flowers
Customers are responsible for sending flowers promptly and following all packing and shipping instructions.

We may photograph flowers upon receipt to document their condition.

After receiving the flowers, we may:

  • Remove damaged, moldy, unsafe, or unusable material;

  • Use the best-preserved portions of a flower;

  • Adjust the planned arrangement;

  • Recommend a different preservation format;

  • Request substitute flowers;

  • Request approval for design modifications; or

  • Decline to work with materials that present a safety, contamination, pest, or quality concern.

We cannot guarantee the condition in which flowers will arrive or that every customer-supplied flower will be usable.

Damage or deterioration occurring before physical receipt by The Keepsake Blossom & Co., including damage caused by delayed shipping, heat, cold, moisture, improper packaging, carrier handling, or natural decomposition, is not the responsibility of The Keepsake Blossom & Co.

9. Customer-Supplied Objects and Sentimental Materials
Customers must obtain written approval before sending objects other than flowers.

These may include:

  • Jewelry;

  • Charms;

  • Photographs;

  • Fabric;

  • Ribbon;

  • Invitations;

  • Memorial items;

  • Religious items;

  • Ashes or cremated remains;

  • Hair;

  • Soil;

  • Metal pieces;

  • Glass;

  • Valuable objects; or

  • Other sentimental materials.

We may decline any material that cannot be safely, legally, or effectively incorporated.

Unless expressly agreed in writing, customers should not send:

  • Cash;

  • Original legal documents;

  • Precious gemstones;

  • High-value jewelry;

  • Firearms or weapons;

  • Hazardous materials;

  • Controlled substances;

  • Biological materials;

  • Illegally obtained materials; or

  • Items with a value that cannot reasonably be replaced.

The customer is responsible for accurately disclosing the nature of all submitted materials.

10. Sentimental and Replacement Value
We understand that flowers and customer-supplied materials may carry substantial emotional value.

However, emotional or sentimental value may be impossible to calculate or replace. Customers are encouraged to retain any portion of a bouquet, flower, photograph, or object that they are unwilling to risk losing.

To the fullest extent permitted by law, the monetary value of customer-supplied flowers or materials will be based on their reasonable replacement value as physical materials, not their emotional, symbolic, or sentimental value.

Nothing in this section excludes liability that cannot legally be limited, including liability arising from willful misconduct, gross negligence, or another basis that applicable law does not permit us to disclaim.

11. Artistic Discretion
Customers acknowledge that floral preservation and handmade design involve artistic judgment.

Unless a written agreement requires an exact placement, we may exercise reasonable artistic discretion regarding:

  • Flower selection;

  • Flower trimming;

  • Composition;

  • Orientation;

  • Spacing;

  • Background placement;

  • Filler material;

  • Greenery;

  • Color balance;

  • Depth;

  • Resin layers;

  • Inclusion or exclusion of damaged material;

  • Lettering placement;

  • Hardware placement; and

  • Overall presentation.

Reference images, inspiration photographs, examples, digital renderings, and previous work are intended to communicate general style.

They do not guarantee an identical result.

Each preservation piece is individually handmade and will be unique.

12. Handmade Characteristics
Handmade products may contain reasonable variations or characteristics such as:

  • Small air bubbles;

  • Minor surface variations;

  • Slight edge variations;

  • Small areas of transparency;

  • Natural flower movement;

  • Variations in flower placement;

  • Differences in depth or spacing;

  • Minor resin-flow patterns;

  • Natural discoloration;

  • Slight variations in engraving;

  • Small differences in acrylic, wood, paint, vinyl, or other materials; and

  • Differences caused by lighting, photography, screens, or display settings.

Reasonable handmade and natural variations are not defects.

13. Quotes and Estimates
Quotes and estimates are based on the information available when they are issued.
Unless otherwise stated, a quote:

  • Is valid for the period written on the quote;

  • May expire if not accepted within that period;

  • Is subject to material availability;

  • May change if the customer changes the scope, size, wording, design, quantity, timing, or materials;

  • Does not reserve a production date until required payment is received; and

  • Does not constitute acceptance of the order until confirmed by us.

Additional costs may apply when:

  • The order requires more work than originally disclosed;

  • The customer requests changes;

  • Special materials must be ordered;

  • Flowers require unusual treatment;

  • Additional products are requested;

  • Packaging or shipping requirements change; or

  • Expedited production is requested and accepted.

We will communicate material additional charges before completing unauthorized additional work.

14. Order Acceptance
An automated order confirmation or payment receipt confirms that we received the order or payment. It does not necessarily mean that we have accepted the order.

We may review orders for:

  • Product availability;

  • Scheduling capacity;

  • Pricing accuracy;

  • Material availability;

  • Shipping restrictions;

  • Payment authorization;

  • Fraud indicators;

  • Design feasibility;

  • Safety concerns; and

  • Compliance with these Terms.

An order is accepted when we provide confirmation of acceptance, begin production, accept customer materials for processing, or otherwise communicate acceptance.

We may decline or cancel an order before acceptance. If we cancel a paid order before production begins, we will return the applicable amount paid, subject to any lawful and clearly disclosed nonrefundable charges already incurred.

15. Pricing and Website Errors
We attempt to provide accurate product descriptions, photographs, availability information, and pricing.
Occasionally, information may contain:

  • Typographical errors;

  • Incorrect prices;

  • Incorrect dimensions;

  • Incorrect availability;

  • Outdated information;

  • Technical errors; or

  • Accidental omissions.

We may correct an error before accepting or fulfilling an order.

When an accepted order is materially affected by an error, we will notify the customer and provide a reasonable opportunity to:

  • Approve the corrected information;

  • Choose an available alternative; or

  • Cancel the affected portion of the order and receive any refund required by law.

We will not substitute materially different goods or impose a higher price without customer approval.

16. Payments

Prices are listed in U.S. dollars unless otherwise stated.

Customers agree to pay:

  • The product or service price;

  • Required deposits;

  • Applicable sales tax;

  • Shipping and handling charges;

  • Insurance or signature charges;

  • Rush fees;

  • Approved change-order charges;

  • Storage or reshipping charges when applicable; and

  • Other charges clearly disclosed before authorization.

Payments may be processed through Wix Payments or another third-party payment provider.

The customer represents that:

  • The payment information provided is accurate;

  • The customer is authorized to use the payment method;

  • Sufficient funds or credit are available; and

  • The payment will not be disputed dishonestly or without a good-faith basis.

We do not intentionally store complete payment-card numbers on our own systems.

17. Deposits and Payment Schedules

Custom orders may require:

  • A nonrefundable booking fee;

  • A deposit;

  • Installment payments;

  • A final balance before shipment; or

  • Full payment before production begins.

The applicable payment schedule will be displayed on the product page, invoice, proposal, or service agreement.

A production date is not reserved until the required payment and information have been received.

Failure to make a scheduled payment may result in:

  • A production delay;

  • Suspension of work;

  • Loss of a reserved production position;

  • Withholding of the completed order;

  • Cancellation under the applicable policy; or

  • Other remedies permitted by the accepted agreement and applicable law.

18. Taxes

Customers are responsible for applicable sales, use, excise, customs, or other transaction taxes, except taxes imposed on our income.

Applicable taxes may be calculated at checkout or included on an invoice.

If a customer claims tax-exempt status, valid documentation must be provided before the transaction is completed.

19. Customer Information

Customers must provide accurate and complete:

  • Contact information;

  • Billing information;

  • Shipping information;

  • Event dates;

  • Personalization;

  • Names and spelling;

  • Product selections;

  • Design instructions;

  • Measurements;

  • Flower-shipping information; and

  • Other order details.

The customer is responsible for delays, errors, or additional expenses caused by incomplete, inaccurate, or late information.

We are not responsible for an item produced according to incorrect information submitted or approved by the customer.

20. Design Proofs and Approvals

A proof may be provided for custom engraving, acrylic signs, lettering, personalization, layouts, or other designs.

Customers must carefully review:

  • Spelling;

  • Grammar;

  • Names;

  • Dates;

  • Numbers;

  • Punctuation;

  • Font;

  • Placement;

  • Dimensions;

  • Colors;

  • Orientation; and

  • Overall layout.

Approval confirms authorization to proceed.

After approval:

  • Production may begin immediately;

  • Changes are not guaranteed;

  • Additional changes may require a fee;

  • Production deadlines may be extended; and

  • Customer-approved errors may not qualify for a free replacement or refund.

When we produce an item differently from the final approved proof or written instructions, the customer may submit a claim under the Returns, Refunds, Cancellations & Replacement Policy.

21. Customer Response Delays

The customer must respond within a reasonable period to requests for:

  • Design selections;

  • Proof approvals;

  • Missing information;

  • Payment;

  • Shipping decisions;

  • Substitution approval; and

  • Other order-related matters.

A customer delay may extend the completion date.

We are not responsible for missed event dates, delayed production, or delayed delivery caused by the customer’s failure to provide timely information, payment, or approval.

If the customer remains unresponsive for an extended period, we may pause the order and provide written notice explaining what is required before production can resume.

22. Production and Completion Times

All production and completion dates are estimates unless expressly guaranteed in writing.

Timelines may be affected by:

  • Flower condition;

  • Drying requirements;

  • Resin curing;

  • Product complexity;

  • Design revisions;

  • Customer response time;

  • Material availability;

  • Equipment failure;

  • Seasonal demand;

  • Business closures;

  • Illness or emergency;

  • Weather;

  • Shipping delays; and

  • Events outside our reasonable control.

A shipping estimate begins after the product is complete and transferred to the carrier. Production time and carrier transit time are separate.

23. Rush Orders

Rush production is available only when expressly approved.

A rush fee:

  • Covers priority scheduling;

  • Does not eliminate required drying or curing periods;

  • Does not guarantee carrier delivery;

  • Does not guarantee completion when a delay is outside our reasonable control; and

  • May be nonrefundable after rush work begins.

A rush deadline is binding only when it is confirmed in writing by The Keepsake Blossom & Co.

24. Shipping

Shipping is governed by our Shipping Policy.

Customers are responsible for:

  • Providing an accurate address;

  • Monitoring tracking;

  • Promptly retrieving delivered packages;

  • Following incoming-flower shipping instructions;

  • Retaining shipping receipts and tracking numbers;

  • Reporting damage within the stated timeframe; and

  • Cooperating with carrier claims.

Carrier delivery dates are generally estimates unless the carrier expressly guarantees the selected service.

Federal rules generally require online sellers of covered merchandise to have a reasonable basis for the advertised shipping time. When covered merchandise cannot be shipped as promised, the seller may need to obtain consent to the delay or provide a refund for the unshipped merchandise.

25. Local Pickup and Delivery

Local pickup or delivery is available only when expressly offered or confirmed.

Customers must wait for written notice that an order is ready.

Pickup customers are responsible for:

  • Arriving during the confirmed window;

  • Transporting the product safely;

  • Bringing an appropriate vehicle;

  • Protecting the item from heat, cold, impact, moisture, and direct sunlight; and

  • Inspecting the item at pickup when reasonably possible.

Risk of customer-caused damage transfers to the customer after the order has been picked up or delivered.

Unclaimed orders may be subject to storage requirements or other reasonable arrangements after written notice. We will not dispose of an unclaimed sentimental preservation piece without providing notice and a reasonable opportunity for retrieval, except when disposal is required for health, safety, or legal reasons.

26. Returns, Refunds, and Cancellations

Returns, refunds, cancellations, and replacements are governed by our separate Returns, Refunds, Cancellations & Replacement Policy.

In general:

  • Personalized and custom products are final sale after production or personalization begins;

  • Floral preservation pieces made from customer-supplied flowers are custom products;

  • Non-personalized products may qualify for return only under the published conditions;

  • Cancellation eligibility depends on timing and whether production has begun;

  • Shipping-damage claims must be reported promptly with photographs and retained packaging; and

  • Refunds are subject to inspection and processing requirements.

The full policy controls over this summary.

Nevada’s consumer-protection laws prohibit specified deceptive practices in connection with the sale of goods and services, making clear and consistent disclosure of commercial terms important.

27. Chargebacks and Payment Disputes

Customers should contact us promptly regarding an order or billing concern, so we have an opportunity to review and address it.

Nothing in these Terms prevents a customer from exercising a lawful right to dispute an unauthorized or improper charge.

However, knowingly submitting a false, fraudulent, or materially misleading chargeback may result in:

  • Suspension of current work;

  • Cancellation of unpaid or uncompleted work where permitted;

  • Submission of order records, approvals, tracking, and communications to the payment provider;

  • Refusal of future orders; and

  • Recovery efforts permitted by law.

We may contest a chargeback using relevant transaction documentation.

28. Promotions and Discount Codes

Promotions and discount codes:

  • Apply only during the stated promotional period;

  • May be limited to particular products or services;

  • May not be combined unless expressly allowed;

  • Have no cash value;

  • Cannot generally be applied retroactively;

  • May exclude deposits, shipping, taxes, rush fees, or custom materials; and

  • May be withdrawn or corrected before an order is accepted when published in error.

A promotion does not override these Terms or the applicable product-specific policy unless expressly stated.

29. Gift Orders

A customer ordering for another person represents that the customer is authorized to provide the recipient’s contact and delivery information.

The purchasing customer remains responsible for:

  • Payment;

  • Personalization accuracy;

  • Proof approval;

  • Shipping-address accuracy;

  • Communications; and

  • Compliance with these Terms.

A gift recipient does not automatically receive cancellation, refund, or modification rights beyond those held by the purchasing customer.

30. Care and Handling

Customers must follow all care instructions provided with the product.

Preservation, resin, acrylic, engraved, painted, adhesive, and handmade products may be damaged by:

  • Direct sunlight;

  • Extreme heat;

  • Freezing temperatures;

  • Water or high humidity;

  • Abrasive cleaners;

  • Alcohol or chemical cleaners;

  • Dropping or impact;

  • Improper mounting;

  • Excessive weight or pressure;

  • Scratching;

  • Outdoor exposure; and

  • Improper storage.

Damage caused by misuse, improper handling, improper installation, environmental exposure, or failure to follow care instructions is not a manufacturing defect.

31. Product Safety

Products must be used only for their intended decorative or functional purpose.

Unless expressly identified otherwise, products are not:

  • Toys;

  • Food-safe;

  • Dishwasher-safe;

  • Microwave-safe;

  • Intended for direct food contact;

  • Intended for outdoor use;

  • Intended for unsupervised use by children;

  • Medical devices; or

  • Designed to support body weight.

Small components may create a choking hazard. Customers are responsible for keeping appropriate products away from children and pets.

32. Customer Accounts

When customer accounts are enabled, customers are responsible for:

  • Maintaining accurate account information;

  • Protecting passwords;

  • Restricting access to their devices;

  • Notifying us of suspected unauthorized access; and

  • Activities conducted through their accounts.

We may suspend or restrict an account when we reasonably believe it is being used:

  • Fraudulently;

  • Unlawfully;

  • To interfere with the website;

  • To abuse another person;

  • To violate these Terms; or

  • In a manner that threatens security or business operations.

33. Acceptable Website Use

You may use the website only for lawful personal or business purchasing purposes.

You may not:

  • Use the website for fraud or unlawful activity;

  • Submit false information;

  • Impersonate another person;

  • Attempt unauthorized access;

  • Introduce malware or harmful code;

  • Scrape, harvest, or copy website data through automated means without permission;

  • Interfere with website security or operation;

  • Use the website to harass or threaten another person;

  • Submit infringing or illegal content;

  • Circumvent purchase limits or security controls;

  • Reverse engineer website features where prohibited by law;

  • Use our designs or photographs to misrepresent your own work; or

  • Use the website in a way that violates another person’s rights.

We may restrict access when reasonably necessary to protect customers, the business, or the website.

34. Intellectual Property

Unless otherwise stated, the website and its original content are owned by or licensed to The Keepsake Blossom & Co.

Protected content may include:

  • Business names;

  • Logos;

  • Photographs;

  • Videos;

  • Product descriptions;

  • Graphics;

  • Templates;

  • Preservation designs;

  • Sign layouts;

  • Engraving layouts;

  • Illustrations;

  • Text;

  • Website design;

  • Marketing materials;

  • Educational materials; and

  • Original product concepts.

You may view the website and print or save order-related information for personal, noncommercial use.

You may not, without written permission:

  • Copy or reproduce our content for commercial use;

  • Sell or distribute our designs;

  • Remove copyright or ownership notices;

  • Use our photographs to advertise another business;

  • Present our work as your own;

  • Create unauthorized derivative commercial products;

  • Use our branding in a misleading way; or

  • Register a confusingly similar business, domain, or social-media identity.

No ownership rights are transferred merely because a customer purchases a physical product.

35. Customer Content and Submitted Materials

Customers retain ownership of original photographs, logos, artwork, wording, and other content they lawfully own.

By submitting content for an order, the customer grants The Keepsake Blossom & Co. a limited, nonexclusive license to use, reproduce, resize, edit, engrave, print, display internally, and otherwise process the content as reasonably necessary to:

  • Evaluate the request;

  • Create the product;

  • Communicate with the customer;

  • Maintain order records;

  • Resolve a dispute; and

  • Fulfill legal or accounting obligations.

This limited license does not automatically authorize public advertising use.

We will not intentionally publish identifiable private photographs, memorial information, or customer content for marketing without permission, except where the content was publicly posted by the customer and may lawfully be reshared.

36. Customer Content Representations

By submitting a photograph, logo, design, quotation, message, artwork, or other content, you represent that:

  • You own it or have permission to use it;

  • Our requested use will not infringe another person’s copyright, trademark, privacy, publicity, or other rights;

  • The content is not unlawful, threatening, defamatory, obscene, or deceptive; and

  • The content does not contain prohibited or harmful material.

We may decline content that presents legal, ethical, safety, or reputational concerns.

The customer is responsible for claims arising from content the customer submitted without proper authorization, subject to applicable law.

37. Reviews, Testimonials, and Social-Media Content

Customers may voluntarily submit reviews, testimonials, photographs, or social-media posts.

By expressly authorizing promotional use, you grant us permission to reproduce, display, crop, resize, and share the authorized content for marketing and portfolio purposes.

Unless otherwise agreed:

  • We may identify you by first name, initials, social-media handle, or the name you authorized;

  • We will not knowingly disclose unnecessary private information;

  • Permission may be withdrawn prospectively by contacting us; and

  • Withdrawal may not require retrieval of materials already printed, distributed, or lawfully published before the request.

38. Third-Party Services

The website may use or link to services provided by:

  • Wix;

  • Payment processors;

  • Shipping carriers;

  • Social-media platforms;

  • Review applications;

  • Analytics providers;

  • Advertising providers;

  • Scheduling tools;

  • Maps;

  • Chat services; and

  • Other external providers.

Third parties operate under their own terms and privacy policies.

We do not control every third-party platform and are not responsible for its independent content, availability, security, accessibility, privacy practices, or service interruptions.

39. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be processed by Wix and other service providers necessary to operate the website, process payments, fulfill orders, communicate with customers, and provide shipping.

The Privacy Policy controls questions specifically concerning personal-information practices.

40. Accessibility

We are committed to improving access to our website and services for individuals with disabilities.

Accessibility practices and contact methods are described in our Accessibility Statement.

A person who encounters an accessibility barrier may contact us to request assistance or an alternative method of accessing information or completing a transaction.

The Department of Justice states that businesses open to the public must provide people with disabilities equal access to the goods and services they offer, including those made available online.

41. Website Availability

We do not guarantee that the website will be available without interruption or error.

Access may be affected by:

  • Maintenance;

  • Wix outages;

  • Internet failures;

  • Hosting issues;

  • Cybersecurity incidents;

  • Software updates;

  • Third-party failures;

  • Equipment problems; or

  • Events beyond our reasonable control.

We may modify, suspend, or discontinue website functions when reasonably necessary.

An interruption does not automatically cancel an existing order or eliminate payment obligations for work already authorized and performed.

42. Disclaimer of Warranties

To the fullest extent permitted by law, the website is provided on an “as available” basis.

Except for express written warranties or rights that cannot legally be excluded, we do not warrant that:

  • The website will always be uninterrupted or error-free;

  • Every digital display will accurately reproduce physical colors;

  • Natural flowers will retain their original appearance;

  • Handmade products will be identical to examples;

  • Every customer-supplied flower will be usable;

  • A preservation piece will remain unchanged indefinitely; or

  • Third-party services will always function as intended.

This disclaimer does not eliminate express promises contained in an accepted order or rights and warranties that applicable law does not permit us to disclaim.

43. Limitation of Liability

To the fullest extent permitted by applicable law, The Keepsake Blossom & Co. will not be liable for indirect, incidental, special, exemplary, punitive, emotional, sentimental, or consequential damages arising from:

  • Website use;

  • A carrier delay;

  • Loss occurring before we receive incoming materials;

  • Natural flower deterioration;

  • Customer-approved errors;

  • Customer misuse;

  • Unauthorized third-party activity;

  • Third-party service interruptions; or

  • Events outside our reasonable control.

Where liability may lawfully be limited, our total monetary liability arising from a particular order will not exceed the amount actually paid to The Keepsake Blossom & Co. for the product or service giving rise to the claim.

This limitation does not apply to liability that applicable law does not permit us to exclude or limit, including liability arising from willful misconduct, gross negligence, or enforceable statutory rights.

44. Indemnification

To the extent permitted by law, you agree to be responsible for reasonably foreseeable claims, losses, or expenses arising from:

  • Your unlawful use of the website;

  • Content you submitted without required permission;

  • Your infringement of another person’s rights;

  • Your fraudulent conduct;

  • Your material violation of these Terms; or

  • Your misuse of a product.

This section does not require a consumer to indemnify us for our own negligence, willful misconduct, unlawful conduct, or responsibility that cannot legally be transferred.

45. Events Beyond Reasonable Control

We are not responsible for delays or failure to perform caused by circumstances outside our reasonable control, including:

  • Natural disasters;

  • Severe weather;

  • Fire;

  • Flood;

  • Earthquake;

  • Public emergencies;

  • Government orders;

  • Transportation interruptions;

  • Carrier disruptions;

  • Labor interruptions;

  • Supply shortages;

  • Power outages;

  • Internet or technology failures;

  • Equipment breakdown;

  • Widespread illness;

  • Civil unrest; or

  • Similar events.

We will make reasonable efforts to communicate material delays and resume performance when reasonably possible.

This provision does not eliminate any cancellation or refund right required by law.

46. Refusal or Termination of Service

We may refuse, suspend, or terminate service when reasonably necessary because of:

  • Fraud or suspected fraud;

  • Threats, harassment, abuse, or discriminatory conduct;

  • Repeated nonpayment;

  • Unauthorized chargebacks;

  • Illegal requests;

  • Unsafe materials;

  • Intellectual-property concerns;

  • Material misrepresentations;

  • Repeated violation of policies;

  • Requests outside our capabilities; or

  • Conduct that threatens customers, employees, contractors, or business operations.

When an accepted order is terminated, payment and refund obligations will be determined based on work already performed, custom materials purchased, the reason for termination, the applicable cancellation policy, and applicable law.

47. Informal Resolution of Concerns

Customers should send an order-related concern to info@thekeepsakeblossom.com.

Please include:

  • Full name;

  • Order number;

  • Contact information;

  • A description of the concern;

  • Relevant dates; and

  • Photographs or supporting documentation.

The parties agree to make a good-faith effort to discuss and resolve the concern before filing a lawsuit, except when immediate legal relief is reasonably necessary or a legal deadline would expire.

This section does not prevent a customer from contacting a government agency, payment provider, attorney, or consumer-protection authority.

48. Governing Law

These Terms and transactions with The Keepsake Blossom & Co. are governed by the laws of the State of Nevada, without regard to conflict-of-law principles, except when another jurisdiction’s non-waivable consumer law applies.

49. Venue

Subject to any non-waivable consumer venue right, legal proceeding arising from these Terms or a transaction with The Keepsake Blossom & Co. must be brought in a court of competent jurisdiction located in Clark County, Nevada.

Eligible claims may be brought in small claims court when the court has jurisdiction.

This agreement does not require private arbitration and does not contain a class-action waiver.

50. Time to Bring a Claim

Any contractual claim must be brought within the legally permitted limitations period.

Nothing in these Terms creates a limitations period shorter than the minimum period required by applicable law or shortens a statutory period that cannot legally be modified.

51. Severability

If a court determines that any provision of these Terms is unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed when necessary.

The remaining provisions will continue in effect.

52. No Waiver

Our failure to enforce a provision on one occasion does not waive the right to enforce it later.

A waiver is effective only when clearly made in writing by an authorized representative of The Keepsake Blossom & Co.

53. Assignment

Customers may not transfer an order, contract, service reservation, or rights under these Terms without written approval.

We may assign these Terms as part of a lawful business reorganization, merger, sale, or transfer, provided the assignment does not eliminate rights already earned by the customer.

54. Headings

Section headings are provided for organization and convenience. They do not limit the meaning of the provisions.

55. Entire Agreement

These Terms, together with the incorporated policies, accepted invoice, approved proposal, product description, proof, and any signed order-specific agreement, constitute the agreement between the parties concerning the transaction.

Statements made outside those documents do not modify the agreement unless confirmed in writing by an authorized representative.

56. Changes to These Terms

We may update these Terms to reflect changes in:

  • Products or services;

  • Business operations;

  • Wix functionality;

  • Payment methods;

  • Applicable laws;

  • Technology;

  • Shipping practices; or

  • Other legitimate business needs.

The updated version will be posted with a revised “Last Updated” date.

The version in effect when an order is placed will generally govern that order unless:

  • The parties agree to a change;

  • A change benefits the customer;

  • A change is required by law; or

  • An order-specific agreement states otherwise.

Material changes will not retroactively reduce rights already earned under an accepted order unless permitted by law and agreed to when required.
